Terms of Service

These Terms of Service explain the rules for using RockHoundR. Please read them before using our mobile app, website, maps, data layers, saved spots, planning tools, and related services (the "Service"). If you do not agree to these Terms, do not use the Service.
Highlights
- RockHoundR is a field-planning and map tool. It is not a land survey, legal access decision, collecting permit, safety guide, or emergency service.
- You are responsible for checking current laws, land ownership, closures, permits, road status, weather, and field conditions before you go.
- Saved spots, lines, notes, reports, and other content you add are your responsibility. Do not add or share content you do not have the right to use.
- Some features depend on third-party providers for maps, geology, land, weather, places, authentication, payments, and infrastructure. Their terms may also apply.
- Rock identification results are estimates for learning, field notes, and personal collections. They are not professional lab, geological, appraisal, safety, or legal advice.
1. Who We Are
The Service is operated by Ruby Glint Co., Ltd., doing business as RockHoundR ("RockHoundR," "we," "us," or "our"). "You" means the person using the Service or the organization on whose behalf the Service is used.
2. Agreement to These Terms
By creating an account, downloading the app, making a purchase, or using any part of the Service, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of a company, club, school, or other organization, you represent that you have authority to bind that organization to these Terms.
3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian.
4. Accounts and Security
Some features require an account. You agree to provide accurate information, keep your login credentials secure, and promptly tell us if you believe your account has been accessed without permission. You are responsible for activity that happens through your account.
RockHoundR may offer guest or anonymous use. Guest data may be limited, device-specific, or lost if you uninstall the app, clear device data, or switch devices before linking an account.
5. License to Use RockHoundR
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, lawful, non-commercial field planning and related use, subject to these Terms. We may offer separate written agreements for business, educational, contributor, or other specialized uses.
The app and website are licensed, not sold. You may not copy, resell, sublicense, reverse engineer, scrape, frame, or use the Service to build a competing map, database, or product unless we give you written permission or applicable law clearly allows it.
6. Outdoor, Access, and Safety Responsibilities
RockHoundR helps you plan rockhounding trips, review map layers, save locations, check nearby geology, estimate conditions, and organize field information. The Service is informational only and should not be your only source for field decisions.
You are responsible for:
- Verifying current land ownership, access rules, closures, permits, collecting limits, and local regulations before entering or collecting on any land.
- Getting permission before entering private, restricted, tribal, leased, military, protected, or otherwise controlled land.
- Checking road, trail, river, fire, flood, weather, daylight, and terrain conditions before and during a trip.
- Carrying appropriate navigation, safety, first-aid, water, food, vehicle, battery, and communication equipment.
- Following all laws and ethical collecting practices, including rules for public lands, parks, wilderness areas, paleontological resources, archaeological resources, cultural sites, and protected species.
Do not use RockHoundR as an emergency service, legal survey, title report, precise boundary authority, professional geological opinion, or substitute for official government records.
7. Map, Geology, Weather, and Other Data
The Service may display map tiles, public-land references, geology layers, place information, amenities, directions, weather, forecasts, coordinates, distances, and other data from RockHoundR and third-party sources. This information can be incomplete, delayed, generalized, mislocated, misclassified, unavailable, or out of date.
Land status, property boundaries, road access, collecting rules, and weather conditions change often. Always verify important information against official sources and current local conditions before taking or avoiding any action.
8. Rock Identifier, Spot Photos, and Collections
RockHoundR's current and planned photo features include a rock identifier, mineral identifier, adding photos to saved spots, and creating a personal rock collection. Identifier results are automated estimates based on limited inputs such as photos, user-provided context, available data, and model behavior. Results may be wrong, incomplete, or unable to distinguish visually similar rocks, minerals, fossils, ore materials, slag, glass, synthetic materials, or altered specimens.
Do not rely on identifier results for safety, toxicity, handling, valuation, sale, scientific publication, mining, legal compliance, collecting permissions, or any decision that requires a qualified geologist, mineralogist, appraiser, assay lab, or other professional. Use proper safety precautions and seek professional testing when accuracy matters.
Spot photos and personal rock collections are for organizing your field records and specimens. You are responsible for the photos, labels, notes, coordinates, and collection details you add, and for making sure you have the right to collect, possess, photograph, and share any specimens or locations you record.
9. User Content
"User Content" means spots, coordinates, notes, favorites, saved lines, reports, feedback, spot photos, identifier photos, rock collection entries, media, text, settings, and other content you upload, save, submit, or share through the Service. You keep ownership of your User Content, subject to the rights you grant us in these Terms.
You grant RockHoundR a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, modify, back up, transmit, and use your User Content as needed to operate, secure, support, and improve the Service. This license includes the right to format or adapt User Content for technical reasons, such as syncing data across devices or displaying it on a map.
Your private saved spots, notes, favorites, and lines are not meant to be shown to other users unless you choose to share them, submit them as feedback or reports, make them public through a feature, or disclosure is otherwise allowed by these Terms or our Privacy Policy. Reports, corrections, public submissions, feedback, and similar content may be reviewed, moderated, used, or displayed by RockHoundR.
10. Content Rules
You agree that you will not submit or use User Content that:
- Is false, misleading, unlawful, defamatory, harassing, or harmful
- Infringes another person's copyright, trademark, privacy, or other rights
- Reveals someone else's private location or personal information without permission
- Encourages trespass, illegal collecting, resource damage, theft, or unsafe conduct
- Contains malware, spam, advertising, automated messages, or abusive material
We may remove, limit, or refuse content, and may suspend accounts when we believe content or behavior violates these Terms, creates risk, or harms the Service or other people.
11. Prohibited Uses
You agree not to:
- Use the Service to trespass, collect illegally, evade closures, or violate land-use rules
- Harass, threaten, impersonate, or harm another person
- Interfere with, overload, attack, probe, or bypass security on the Service
- Use bots, scrapers, crawlers, or automated tools to copy or archive the Service
- Sell, rent, transfer, or commercially exploit your account or access to the Service
- Reverse engineer the app or attempt to extract source code, map data, or database records
- Remove attribution, copyright notices, trademarks, map credits, or provider notices
- Use identifier results as a substitute for professional testing or safety review
- Use the Service for any unlawful, dangerous, or unauthorized purpose
12. Subscriptions, Billing, and App Stores
RockHoundR may offer free and paid features. Purchases and subscriptions made through Apple App Store, Google Play, or another app marketplace are handled by that marketplace. Its terms, payment rules, renewal rules, cancellation process, and refund policies apply.
Unless cancelled in the manner required by the applicable marketplace, subscriptions may renew automatically. Deleting the app usually does not cancel a subscription. Manage cancellation and refund requests through the store or provider that processed the purchase.
13. Third-Party Services and Data Providers
The Service may use or link to third-party services, software, maps, data, APIs, or platforms, including providers for authentication, hosting, crash reporting, maps, geocoding, directions, geology, public data, amenities, weather, photo analysis, machine learning, app-store payments, and support. Examples may include Apple, Google, Firebase, Mapbox, Macrostrat, OpenStreetMap/Overpass, weather providers, and similar services.
Third-party services are not controlled by RockHoundR. Their own terms, licenses, privacy policies, fees, attribution requirements, availability, and restrictions may apply. We are not responsible for third-party content, data, services, websites, or decisions.
14. Feedback
If you send us ideas, corrections, suggestions, bug reports, or other feedback, you allow RockHoundR to use them without restriction or compensation. This helps us improve maps, features, wording, support, and product direction.
15. Intellectual Property
RockHoundR, the Service, the app design, website, software, text, graphics, logos, compilation, and other materials are owned by RockHoundR or its licensors and are protected by intellectual property laws. Except for the limited license granted to you, we reserve all rights in the Service.
16. Changes to the Service
We may add, change, suspend, limit, or discontinue any feature, data layer, provider, plan, or part of the Service at any time. We may also release updates that are needed for security, compatibility, or continued use.
17. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create legal or security risk, misuse the Service, or if we stop offering all or part of the Service. After termination, provisions that by their nature should survive will continue to apply, including ownership, disclaimers, limitations of liability, indemnity, and dispute provisions.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, secure, error-free, accurate, complete, current, available in all areas, or suitable for your intended trip, route, collection site, rock identification, safety plan, or legal decision.
19. Limitation of Liability
To the maximum extent permitted by law, RockHoundR and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, access, field time, travel costs, specimens, equipment, or personal injury arising from or related to the Service.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of the amount you paid to RockHoundR for the Service in the 12 months before the claim or USD $100.
20. Indemnity
You agree to defend, indemnify, and hold harmless RockHoundR and its owners, employees, contractors, affiliates, service providers, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, your violation of law, or your violation of another person's rights.
21. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law rules. Where arbitration is not required or is unavailable, you agree to the exclusive jurisdiction of the courts of Thailand, except where applicable law requires otherwise.
22. Arbitration and Class Action Waiver
To the extent permitted by law, disputes arising from or related to these Terms or the Service must be resolved through binding individual arbitration administered by the Thailand Arbitration Center (THAC). Claims may be brought only on an individual basis, not as a plaintiff or class member in a class, consolidated, representative, or private attorney general action.
23. Severability and Waiver
If any part of these Terms is found unenforceable, the remaining parts will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
24. Changes to These Terms
We may update these Terms from time to time. The updated version is effective when posted unless a different effective date is stated. If changes are material, we may provide additional notice through the Service, by email, or by other reasonable means. Continued use of the Service after an update means you accept the updated Terms.
